Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and DoorBird Installers, a division of Pixel Security Consultants Group ("Company," "we," "us," or "our"), governing your access to and use of the website doorbirdinstallers.com (the "Site") and any purchases made through the Site.

BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SITE.

We reserve the right to modify these Terms at any time. Changes are effective upon posting to the Site. Your continued use of the Site constitutes acceptance of modified Terms.

2. Company Information

DoorBird Installers is an authorized dealer of DoorBird products manufactured by Bird Home Automation GmbH. We are not the manufacturer. DoorBird is a registered trademark of Bird Home Automation GmbH, Germany.

3. Eligibility

By using the Site, you represent and warrant that you:

  • Are at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Are not prohibited from using the Site under applicable laws
  • Will provide accurate and complete information

4. User Accounts

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or for any reason at our sole discretion.

5. Products and Services

Product Descriptions

We strive to provide accurate product descriptions, images, and specifications. However, we do not warrant that descriptions are complete, accurate, current, or error-free. Product images are for illustration purposes and may vary from actual products. If a product is not as described, your sole remedy is to return it in accordance with our Return Policy.

Product Availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse orders at any time. Availability displayed on the Site is approximate and subject to change without notice.

Installation Services

Professional installation services are available in select areas and are subject to separate terms and scheduling. Installation quotes are estimates and final pricing may vary based on site conditions and requirements discovered during installation.

6. Pricing and Payment

Pricing

  • All prices are displayed in US dollars (USD)
  • Prices do not include applicable taxes, shipping, or installation unless expressly stated
  • We reserve the right to change prices at any time without notice
  • In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price
  • Promotional prices are valid only during the specified promotion period

Payment

  • Payment is required at the time of order unless otherwise agreed in writing
  • We accept major credit cards and other payment methods as displayed at checkout
  • Payment processing is handled by secure third-party processors
  • You represent that you are authorized to use the payment method provided
  • We reserve the right to refuse or cancel orders suspected of fraud

Sales Tax

Applicable sales tax will be calculated based on your shipping address and added to your order total. It is your responsibility to pay any additional taxes or duties for international orders.

7. Orders and Acceptance

Submission of an order constitutes an offer to purchase, not a binding contract. We reserve the right to accept or reject any order at our sole discretion. An order is accepted only when we send an order confirmation email. We may cancel accepted orders due to:

  • Product unavailability
  • Pricing or description errors
  • Suspected fraud
  • Credit or payment issues
  • Inability to ship to provided address

8. Shipping and Delivery

  • Shipping costs and estimated delivery times are provided at checkout
  • Delivery dates are estimates only and not guaranteed
  • Risk of loss passes to you upon delivery to the carrier
  • We are not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our control
  • You are responsible for providing accurate shipping information
  • Additional charges may apply for reshipment due to address errors or refused delivery

9. Returns and Refunds

Return Policy

  • Unopened products in original packaging may be returned within 30 days of delivery
  • A restocking fee of up to 20% may apply to returns
  • Return shipping costs are the responsibility of the customer unless the return is due to our error
  • Refunds will be issued to the original payment method within 10-14 business days of receiving the return

Non-Returnable Items

  • Opened or used products (except for defects)
  • Custom or special-order items
  • Products damaged by customer misuse or improper installation
  • Products without original packaging
  • Installation services once performed

Defective Products

Defective products are covered under the manufacturer's warranty. Please contact us at support@doorbirdinstallers.com to initiate a warranty claim. We will assist with the warranty process but final determination is made by the manufacturer.

10. Quote Requests

Quote requests submitted through the Site are requests for information only and do not constitute binding orders. Quotes are valid for 30 days from issuance unless otherwise stated. Final pricing may vary based on actual requirements, site conditions, and current pricing at time of order.

11. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of DoorBird Installers, Pixel Security Consultants Group, or our licensors and is protected by copyright, trademark, and other intellectual property laws.

DoorBird® is a registered trademark of Bird Home Automation GmbH. All other trademarks are the property of their respective owners.

You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent.

12. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose
  • Interfere with or disrupt the Site or servers
  • Attempt to gain unauthorized access to any part of the Site
  • Use automated systems to access the Site without permission
  • Transmit viruses, malware, or other harmful code
  • Collect user information without consent
  • Impersonate any person or entity
  • Use the Site to compete with our business

13. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free
  • Products will meet your specific requirements
  • Product descriptions or specifications are accurate or complete
  • Any defects will be corrected

Product warranties are provided solely by the manufacturer and are subject to the manufacturer's warranty terms and conditions.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOORBIRD INSTALLERS, PIXEL SECURITY CONSULTANTS GROUP, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Business interruption
  • Cost of substitute products or services
  • Property damage
  • Personal injury (except where prohibited by law)

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow limitations on implied warranties or liability, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless DoorBird Installers, Pixel Security Consultants Group, and their officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws
  • Any content you submit to the Site

16. Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to first contact us at info@doorbirdinstallers.com to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.

Binding Arbitration

If informal resolution is unsuccessful, any dispute arising from these Terms shall be resolved by binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.

Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Site.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

19. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and DoorBird Installers regarding your use of the Site and supersede all prior agreements and understandings.

21. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

22. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, supply chain disruptions, or pandemic.
